THE GARBAGE COMPANY
TERMS OF SERVICE
These Terms of Service ("Terms") govern your access to and use of the waste collection services provided by Givernii Pty Ltd trading as the Garbage Company (ABN: 14 674 081 424) ("TGC", "we", "us", or "our"). By obtaining, booking, or continuing to use our services (whether online, by phone, or through any other channel) you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our services. These Terms apply to all customers, including individuals, households, and businesses. Where our services are acquired for personal, domestic, or household use, the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (the Australian Consumer Law) also applies and grants you rights and remedies that cannot be excluded or limited by contract.

SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or territory of residence. To use the Services, including purchasing any of the collection plans we offer, you may be asked to provide information such as your email address, billing information, and service address. You represent and warrant that all information provided is correct and current. You are solely responsible for maintaining the security of your account credentials.
SECTION 2 – OUR SERVICES
We have made every effort to provide an accurate representation of our bin sizes and service plans. We do not warrant that the quality of any services purchased will meet your expectations or be exactly as depicted in our online store, except to the extent required under the Australian Consumer Law. All descriptions of services (including collection frequencies and waste types) are subject to change, provided we give you at least 14 days’ prior written notice of any material change. We reserve the right to limit the provision of Services to any person, geographic region, or jurisdiction.
TGC currently offers two types of services: (a) a recurring weekly subscription collection service, which operates on a subscription basis as described in Section 4A; and (b) an on-demand wheelie bin collection service, which is booked and charged separately for each collection. Except where expressly stated otherwise, references in these Terms to a "subscription" or "subscription plan" apply only to the weekly subscription service and not to on-demand bookings.
SECTION 3 – SERVICE ORDERS
When you place an order for a service plan, you are making an offer to purchase. TGC reserves the right to accept or decline your order for any reason (for example, if your address is outside our service area). Your order is not accepted until we confirm acceptance. Please review your service address carefully before submitting. Cancellations, modifications and any refunds are governed by these Terms of Service, including Section 4A (Subscriptions, Cancellations and Refunds).
SECTION 4 – PRICES AND BILLING
Prices for collection plans may be reviewed from time to time. Any price increase applicable to your existing subscription will be communicated to you in writing at least 14 days before the increase takes effect. If you do not wish to accept a price increase, you may cancel your subscription in accordance with Section 4A before the increase takes effect without incurring any early cancellation penalty. The price charged will be the price confirmed at the time your order was accepted. You represent and warrant that you are authorised to use the payment method provided and that you will pay all charges incurred, including any applicable taxes or environmental levies.
SECTION 4A – SUBSCRIPTIONS, CANCELLATIONS AND REFUNDS
Certain services are provided on a recurring subscription basis. By purchasing a subscription, you authorise TGC to charge your nominated payment method on a recurring basis in accordance with your selected plan.
Customers are responsible for ensuring that their payment method remains valid and has sufficient funds available to process subscription payments.
If a payment fails, TGC will attempt to process the payment again on the following day. If that attempt also fails, the scheduled collection for that week will be skipped and moved to the following week's collection cycle. Your subscription will not be cancelled as a result of a failed payment unless you notify us that you wish to cancel, or you cancel the subscription yourself in accordance with our Cancellation Policy detailed in Schedule 1 (Cancellation Policy). We will continue attempting to process future scheduled payments in accordance with your subscription plan unless and until the subscription is cancelled.
Subscription charges will continue in accordance with the selected plan until cancelled.
Minimum Commitment
Where a minimum service commitment applies, customers may not cancel their subscription until the minimum number of successful collections has been completed. For subscriptions subject to a minimum commitment of four (4) successful collections, cancellation requests submitted before the completion of four successful collections will not take effect until the minimum commitment has been satisfied.
Nothing in this clause prevents a customer from exercising their statutory rights under the Australian Consumer Law, including the right to a refund or cancellation where TGC has failed to comply with a consumer guarantee.
Changes to Subscription Plans
TGC reserves the right to modify collection schedules, service areas, or subscription plans from time to time. We will provide you with at least 14 days' written notice of any material change to your subscription plan. If you do not accept a material change, you may cancel your subscription before the change takes effect without incurring any early cancellation penalty.
TGC reserves the right to cancel or terminate any subscription where these Terms are breached or where continued service is not reasonably practicable, subject to our obligations under the Australian Consumer Law.
Refunds and Remedies
Your rights under the Australian Consumer Law cannot be excluded, restricted, or modified. Nothing in these Terms limits any right or remedy you have under the Australian Consumer Law.
Without limiting your statutory rights, the following policy applies:
(a) If a collection is missed due to a reason within our control (and not a Force Majeure Event as described in Section 5), we will reschedule the collection at no additional cost within 5 business days, or, if we are unable to reschedule within that time, provide you with a service credit or refund equal to the pro-rata value of the missed collection.
(b) If TGC is unable to provide a service you have paid for (other than for reasons set out in Section 5), you are entitled to a refund of the amount paid for that specific service.
(c) If a collection cannot be completed due to circumstances described in Sections 5, 5A and 22 (including inaccessible bins, locked gates, or prohibited waste), no refund or rescheduling will be provided, unless otherwise agreed.
(d) For refund requests not covered above, TGC will assess requests on their merits and may, at its discretion, offer a full or partial refund or credit. Any approved refund will be processed using the original payment method unless otherwise agreed.
SECTION 4B – GOODS AND SERVICES TAX
Unless otherwise expressly stated, all prices displayed on our website and in communications are inclusive of Goods and Services Tax (GST) where applicable under the A New Tax System (Goods and Services Tax) Act 1999 (Cth).
If any supply made under or in connection with these Terms is subject to GST and the consideration for that supply does not include GST, the recipient must pay an additional amount equal to the GST payable on that supply. TGC will issue a valid tax invoice in respect of any taxable supply.
SECTION 4C – OVERDUE AMOUNTS AND DEBT RECOVERY
If any amount payable under these Terms remains unpaid after the due date, TGC may:
(a) suspend the provision of services until all outstanding amounts are paid in full;
(b) cancel the subscription in accordance with Section 14; and
(c) recover from you the reasonable administrative and debt recovery costs actually incurred by TGC in recovering the overdue amount, including the reasonable fees of any debt collection agency engaged by TGC (not exceeding the amounts permitted under applicable legislation).
TGC will not charge interest on overdue amounts unless separately agreed in writing.
Nothing in this clause affects TGC's right to pursue overdue amounts through a court of competent jurisdiction, in which case costs will be determined by the court.
SECTION 5 – COLLECTION AND PERFORMANCE
We are not liable for delays in bin collections or missed collections due to events genuinely outside our control, including extreme weather, natural disasters, road closures, government-directed road restrictions, major vehicle breakdown, pandemics, epidemics, industrial action, government orders or directives, civil unrest, or disruption to waste disposal facilities (each a "Force Majeure Event"). TGC will use reasonable endeavours to resume services promptly after a Force Majeure Event ceases, but is not required to provide refunds, credits, or rescheduling for collections affected by a Force Majeure Event.
Where a collection is missed for a reason within our control (and not a Force Majeure Event), we will reschedule the collection at no additional cost within 5 business days, or, if we are unable to reschedule within that period, provide you with a service credit or refund equal to the pro-rata value of the missed collection.
All collection schedules provided are estimates only. It is your responsibility to ensure bins are accessible and that we are able to safely enter the property and reach the bin location as outlined in Section 22.
SECTION 5A – WASTE COLLECTION CONDITIONS
Bin Size and Service Selection
Customers are responsible for selecting the correct bin size and waste type when booking a service. If the actual bin size exceeds the booked bin size, or the waste type differs from the booked service, TGC may refuse collection, adjust the booking, charge the difference in price, or, where appropriate, issue a full or partial refund in accordance with Section 4A.
TGC only services wheelie bins up to and including 240 litres. We reserve the right to refuse collection of any bin exceeding 240 litres or any waste container that is not a standard residential wheelie bin.
Permitted Waste
Our services are intended only for general waste and recycling waste as specified in the selected service. By presenting a bin for collection, you represent and warrant that the bin does not contain any prohibited waste as described in this Section 5A and that all waste placed in the bin complies with all applicable laws and waste disposal requirements. Unless expressly stated otherwise, our services do not include green waste, garden waste, food organics, or other specialised waste streams.
Prohibited Waste
CUSTOMERS MUST NOTIFY TGC IMMEDIATELY IF THEY BECOME AWARE THAT PROHIBITED WASTE HAS BEEN PLACED IN A BIN PRESENTED FOR COLLECTION.
The following items must not be placed in bins presented for collection:
• Asbestos or asbestos-containing materials
• Chemicals, solvents, paints, oils, fuels, or hazardous substances
• Batteries, gas cylinders, or explosive materials
• Medical, biological, or infectious waste
• Liquid waste
• Hot ashes, burning materials, or flammable substances
• Soil, bricks, concrete, rocks, or other construction materials
• Any material that cannot be legally disposed of through standard waste disposal facilities
We reserve the right to refuse collection where prohibited materials are identified. Where prohibited materials are discovered after collection has occurred, the customer remains liable for all costs, losses, and expenses incurred by TGC as a result, in accordance with Section 5A (Contaminated or Incorrect Waste).
Contaminated or Incorrect Waste
If a bin contains waste that does not match the booked service type, contains prohibited materials, or is otherwise contaminated, we may refuse collection, partially collect the waste, charge reasonable additional fees, or recover from you all reasonable costs, losses, and expenses actually incurred by TGC as a result, including (without limitation) disposal, transport, cleaning, handling, decontamination, equipment repair, regulatory fines or penalties, and any third-party claims arising from the prohibited or contaminated waste.
Overloaded and Excessively Heavy Bins
Bins must not be overloaded or exceed safe lifting limits. Bin lids should be able to close completely and waste must not be compacted in a manner that prevents safe emptying.
Where a bin is considered unsafe to lift, excessively heavy, or likely to cause damage to collection equipment, we may refuse collection, partially empty the bin, or charge reasonable additional fees commensurate with the additional work required. You are liable for any damage to TGC’s equipment caused by overloaded, excessively heavy, or improperly packed bins.
Additional Waste Outside the Bin
Unless expressly agreed in writing, collection services apply only to the booked bin. Waste, rubbish bags, boxes, or other materials placed outside the bin are not included in the service and may incur reasonable additional charges agreed in advance where practicable.
Photographic Evidence
TGC may take photographs before, during, or after collection for operational purposes, quality assurance, training, safety compliance, dispute resolution, service verification, and chargeback disputes. Such photographs may include bins, waste contents, access conditions, and collection outcomes. By using our services, you consent to TGC taking and retaining such photographs. Photographs will be handled in accordance with our Privacy Policy.
SECTION 5B – PUBLIC HOLIDAYS AND SCHEDULE VARIATIONS
Collection services may be affected by public holidays. Where a scheduled collection falls on or near a public holiday in your state or territory, TGC may reschedule the collection to an alternate day within the same week or the immediately following week.
TGC will use reasonable endeavours to notify you of any collection day changes caused by public holidays, either via email, SMS, or a notice on our website.
No additional charge will be made for a collection rescheduled due to a public holiday. Where TGC is unable to reschedule a collection affected by a public holiday within the timeframe set out above, TGC will provide a service credit or pro-rata refund for the affected collection.
SECTION 6 – INTELLECTUAL PROPERTY
Our Services, including logos, text, and images, are the property of TGC. Unauthorised use of these marks, or any content found on this site, is strictly prohibited. These Terms permit you to use the Services only.
SECTION 7 – OPTIONAL TOOLS
We may provide access to third-party tools (such as scheduling or mapping tools). We provide these “as is” and, to the extent permitted by law, shall have no liability arising from your use of these optional third-party tools. Nothing in this clause limits any right or guarantee you have under the Australian Consumer Law.
SECTION 8 – THIRD-PARTY LINKS
Our site may contain links to third-party websites (such as local council waste guidelines). We are not responsible for the content or accuracy of these external sites.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
TGC is powered by Shopify. However, any service agreements are made directly between you and TGC. Shopify is not responsible for the performance of the bin collection services or any loss resulting from them.
SECTION 10 – PRIVACY POLICY
All personal information, including service addresses, is handled according to our Privacy Policy. By using the Services, you acknowledge you have read our Privacy Policy.
SECTION 11 – FEEDBACK
If you voluntarily provide reviews or feedback about our services, you grant us a non-exclusive, royalty-free, worldwide licence to use that content for purposes including improving our services and marketing. We reserve the right to remove feedback we deem offensive, unlawful, or in breach of our community standards.
SECTION 12 – ERRORS AND OMISSIONS
Occasionally, information on our site may contain errors regarding collection dates, bin sizes, or pricing. We reserve the right to correct these errors and, where an order was placed in clear reliance on materially incorrect pricing or information, cancel that order and provide a full refund of any amount paid.
SECTION 13 – PROHIBITED USES
You may not use our services for unlawful purposes, to violate local waste regulations, to harass or threaten our staff, or to upload malicious code to our website. Breach of this clause may result in suspension or termination of your service in accordance with Section 14.
SECTION 14 – TERMINATION
We may terminate your service plan if you breach these Terms and fail to remedy the breach within a reasonable time after receiving written notice from us. We may terminate your service plan immediately and without a cure period where the breach involves the placement of prohibited waste in a bin, a serious safety risk, or conduct described in Section 23. You may cancel your subscription at any time in accordance with Section 4A. You remain liable for all amounts properly due up to the date of termination.
Termination does not affect any rights or remedies that have already accrued to either party prior to the date of termination.
SECTION 15 – DISCLAIMER OF WARRANTIES
Our services are provided with the care and skill reasonably expected of a professional waste collection business. To the extent permitted by law, we do not guarantee that the service will be uninterrupted or error-free. Nothing in this clause limits any right or guarantee you have under the Australian Consumer Law.
SECTION 16 – LIMITATION OF LIABILITY
To the maximum extent permitted by law, TGC's liability to you for any loss, damage, expense, delay, or claim arising from or relating to the use of our services is limited to, at TGC's election:
(a) the resupply of the relevant service; or
(b) a refund of the amount paid by you for the specific service giving rise to the claim.
This limitation applies to any damage caused by bins, collection vehicles, access to property, missed or delayed collections, or the refusal of a collection for safety or operational reasons, except to the extent caused by TGC's gross negligence or wilful misconduct, or where liability cannot be excluded or limited by applicable law.
We are not liable for any loss, additional disposal costs, fines, penalties, delays, or other expenses arising from incorrect information provided by the customer, including incorrect bin size, waste type, bin location, access instructions, or the presence of prohibited, contaminated, overloaded, or unsafe waste.
Nothing in these Terms excludes, restricts, or modifies:
(a) any consumer guarantee under the Australian Consumer Law;
(b) any right to remedies for failure to comply with a consumer guarantee under the Australian Consumer Law;
(c) any other liability that cannot be limited or excluded by applicable law.
Where the Australian Consumer Law applies and the services are not of a kind ordinarily acquired for personal, domestic, or household use or consumption, our liability for failure to comply with a consumer guarantee is limited to the cost of resupplying the services or paying the cost of having the services resupplied.
SECTION 17 – INDEMNIFICATION
You agree to indemnify and hold TGC harmless against any claims (including third-party claims), losses, liabilities, damages, fines, penalties, and reasonable legal costs arising directly from:
(a) your breach of these Terms (including, without limitation, the placement of prohibited or contaminated waste in a bin in breach of Section 5A); or
(b) your negligence or unlawful conduct in connection with the use of our services.
This indemnity does not apply to the extent that any loss or claim arises from the negligence, unlawful conduct, or breach of these Terms by TGC.
SECTION 18 – SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
SECTION 19 – ENTIRE AGREEMENT
These Terms and our Privacy Policy constitute the entire agreement between you and TGC regarding your use of our Services. You acknowledge that you have not relied on any representation, warranty, or statement made by TGC that is not set out in these Terms.
SECTION 20 – GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Victoria and the courts of appeal from them. These Terms apply to customers across Australia, including New South Wales and any other State or Territory in which TGC offers its services from time to time.
SECTION 21 – CHANGES TO TERMS
We reserve the right to update these Terms at any time. We will provide reasonable notice of any material changes by posting updated Terms on our website and, where reasonably practicable, notifying you by email at least 14 days before the changes take effect.
If you do not accept the updated Terms, you may cancel your subscription before the changes take effect without incurring any early cancellation penalty. Your continued use of the service after the effective date of updated Terms constitutes your acceptance of the new Terms.
SECTION 22 – PROPERTY ACCESS AND COLLECTION AUTHORITY
By booking, confirming, or receiving a bin collection service, you expressly authorise TGC and its employees, contractors, subcontractors, and agents to enter your property for the purpose of locating, accessing, moving, and emptying your nominated wheelie bin(s) or waste items.
You acknowledge and agree that:
Right of Access
You grant us permission to enter the areas of your property reasonably required to perform the service, including driveways, carports, side paths, front yards, and bin storage areas, even if you are not present at the time of collection.
Safe and Clear Access
You are responsible for ensuring safe, unobstructed access to the bin(s), including:
• Unlocked gates and accessible entry points
• No aggressive, unrestrained, or uncontrolled animals on the property
• No vehicles blocking access to the bin(s)
• No hazards such as loose surfaces, construction materials, dangerous obstacles, or unsafe conditions
Customers must ensure that all pets and animals are securely restrained during collection. If our staff reasonably believe that an animal or any other condition poses a safety risk, we may decline to proceed with the collection and the service may be treated as completed for that visit.
Authority to Move Bins
You authorise our team to move your bin(s) from their storage location to our collection point and return them to a reasonable position on your property after servicing.
Risk and Property Conditions
You accept that access may involve standard operational movement of bins across driveways, paths, or lawns. We are not liable for minor surface marks, wheel tracks, or ordinary wear that may occur during normal collection, except where caused by our negligence.
Third-Party Property
If bins are located on property not owned by you, you represent and warrant that you have the legal authority to grant us access to that property, and you indemnify TGC against any claims, losses, or costs arising from access to that property in reliance on your authorisation.
Failure to Provide Access
If we are unable to access the bin(s) due to locked gates, obstructions, safety concerns, or restricted entry, we will make reasonable attempts to contact you. If access cannot be obtained despite those attempts, the service for that visit may be treated as completed and no refund or rescheduling will be required. We will notify you that the collection could not be completed.
SECTION 23 – STAFF SAFETY AND CUSTOMER CONDUCT
TGC is committed to providing a safe working environment for its employees and contractors. Customers must not engage in conduct that threatens, abuses, harasses, or intimidates any TGC employee or contractor.
Examples of unacceptable conduct include (but are not limited to):
• Verbal abuse, threats, or aggressive behaviour directed at TGC staff;
• Physical intimidation or threatening gestures;
• Discriminatory or offensive language; or
• Deliberate obstruction of collection activities.
Where TGC reasonably determines that a customer has engaged in conduct of the kind described above, TGC may:
(a) suspend service immediately for that collection day;
(b) issue a written warning to the customer; and/or
(c) terminate the subscription in accordance with Section 14 where the conduct is serious or repeated.
Where suspension or termination follows a serious threat to the safety of TGC staff, no notice period under Section 14 will be required. A refund will be provided for any prepaid service not yet delivered, less any reasonable costs or losses actually incurred by TGC as a result of the customer’s conduct.
SECTION 24 – COMPLAINTS AND DISPUTE RESOLUTION
TGC is committed to resolving customer complaints fairly and promptly.
Complaints Process
If you have a complaint about our services, please contact us at contact@thegarbagecompany.com.au with details of your complaint. We will acknowledge your complaint within 2 business days and endeavour to provide a substantive response within 10 business days.
Legal Proceedings
Nothing in this clause prevents either party from commencing legal proceedings at any time, including seeking urgent injunctive or interlocutory relief from a court of competent jurisdiction.
SECTION 25 – NOTICES
Unless otherwise specified in these Terms, any notice, communication, or consent required or permitted under these Terms may be given:
(a) by TGC to you: by email to your registered email address, by posting a notice on our website, or by SMS to your registered mobile number; or
(b) by you to TGC: by email to contact@thegarbagecompany.com.au.
A notice sent by email is taken to be received 24 hours after the time it is sent (or, if sent after 5:00 pm on a business day or on a non-business day, 24 hours after 9:00 am on the next business day), unless the sender receives an automated notification that delivery has failed.
A notice posted on TGC's website is taken to be received at the time it is published, provided TGC has taken reasonable steps to notify customers of the posting (for example, by sending an email or SMS alert).
SECTION 26 – LIMITATION PERIOD FOR CLAIMS
Subject to any applicable mandatory law (including the Australian Consumer Law and any applicable limitation period imposed by statute), any claim arising out of or in connection with these Terms or the services must be notified to the other party in writing within 12 months of the date on which the relevant act, omission, or event giving rise to the claim first occurred or became known to the claimant.
This clause applies equally to claims by TGC against customers and to claims by customers against TGC, except that claims by TGC for overdue amounts under Section 4C are not subject to this notification requirement and remain subject to the applicable statutory limitation period.
This clause does not affect any right or remedy arising under the Australian Consumer Law, including any right to bring a claim within the applicable statutory limitation period.
SECTION 27 – SURVIVAL
The following provisions survive the expiry or termination of these Terms for any reason:
• Section 4C (Overdue Amounts and Debt Recovery) — to the extent of any amounts outstanding at termination
• Section 5A (Prohibited Waste)
• Section 6 (Intellectual Property)
• Section 16 (Limitation of Liability)
• Section 17 (Indemnification)
• Section 18 (Severability)

• Section 24 (Complaints and Dispute Resolution)
• Section 26 (Limitation Period for Claims)
• Section 27 (Survival)
SECTION 28 – AUSTRALIAN CONSUMER LAW
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services re-performed if they do not meet an acceptable standard and the failure does not amount to a major failure.

SCHEDULE 1 – SUBSCRIPTION SERVICE CANCELLATION POLICY
This Schedule sets out TGC’s cancellation policy for the recurring weekly subscription collection service referred to in Section 4A of these Terms. This Schedule does not apply to on-demand bookings, which may be cancelled or amended in accordance with Section 3 above. Nothing in this Schedule limits any right or remedy you have under the Australian Consumer Law that cannot be excluded, restricted, or modified by contract.
1. Minimum Commitment Period
All new subscriptions are subject to a minimum commitment period of four (4) weeks, equivalent to four (4) successful weekly collections (the “Minimum Commitment Period”). You are eligible to cancel your subscription only after the Minimum Commitment Period has been completed, that is, after the fourth weekly service charge has been successfully processed. You may schedule a cancellation to take effect at the end of the Minimum Commitment Period at any time, but you remain responsible for all service charges incurred during the Minimum Commitment Period. Nothing in this clause limits any right you have to cancel, or to a refund or other remedy, where TGC fails to comply with a consumer guarantee under the Australian Consumer Law, or otherwise affects any right that cannot be excluded, restricted, or modified under the Australian Consumer Law.
2. Managing Your Service (Skipping, Pausing and Rescheduling)
You may manage your service at any time, including during the Minimum Commitment Period, by:
(a) skipping your next scheduled collection and charge, provided you do so before the cut-off for that service cycle;
(b) pausing your service for a maximum period of four (4) weeks, with billing automatically resuming once the pause period ends; or
(c) rescheduling the date of your next collection and charge.
Using the skip, pause, or reschedule function does not count towards, and does not accelerate, the end of the Minimum Commitment Period.
3. How to Cancel Your Subscription
To cancel your subscription: (a) log into your Customer Account Portal on our website; (b) navigate to the ‘Manage Subscription’ section; and (c) select ‘Cancel Service’ and follow the prompts. Your service will remain active until the end of your current billing cycle or, if applicable, the Minimum Commitment Period, and you will not be charged again after the effective cancellation date.
4. Refunds
Once a weekly subscription charge has been successfully processed, that charge is non-refundable, and TGC does not provide refunds or pro-rata credits for cancellations made during an already-paid service cycle. This clause does not limit any right you have under the Australian Consumer Law, including your right to a refund or other remedy where TGC fails to comply with a consumer guarantee (see Section 4A and Section 28 of these Terms).
Where TGC fails to comply with a consumer guarantee under the Australian Consumer Law: (a) for a major failure, you are entitled to a refund or replacement of the relevant service, and compensation for any other reasonably foreseeable loss or damage; and (b) for a failure that is not a major failure, you are entitled to have the service re-performed within a reasonable time or, if TGC is unable to do so, a refund. This clause applies regardless of the Minimum Commitment Period or the non-refundable position described above, which apply only to the extent consistent with your rights under the Australian Consumer Law. See Section 4A and Section 28 of these Terms for further detail on your consumer guarantee rights.
5. Automatic Renewal
Your subscription will automatically renew at the end of each billing cycle (weekly) unless you cancel it in accordance with this Schedule prior to your next scheduled charge date.
